SC issues interim order in favor of Dhaka; to not lose MP post right away

The Supreme Court (SC) has issued a short-term interim order not to prosecute Dhaka Kumar Shrestha, the suspended Member of Parliament (MP) of the Rastriya Swatantra Party (RSP).

A single bench of Supreme Court Justice Til Prasad Shrestha today issued an interim order not to implement the decision to remove Dhaka from the post of MP with suspension.

The court has also ordered to show cause with the RSP Central Conduct and Disciplinary Committee regarding the action taken against Dhaka in this case.

Along with this, he is not going to lose his post as MP. He was a proportional MP in the House of Representatives from RSP.

The Supreme Court ordered the opposition to show cause regarding the action against Dhaka and also asked both parties to discuss the interim order. The post of proportional MP Dhaka, who was linked to Durga Prasai in the Rs 20 million bribery case, lay vacant from last April 25.

According to the circular issued by the RSP, Speaker Devraj Ghimire read out the notice that Shrestha's MP post was vacant in the Parliament meeting. After leaving Dhaka's post, Bindabasini Kansakar, who was number two in the tribal cluster list, was elected as MP from RSP.

RSP had already sent a letter to the Parliament Secretariat with the decision to remove Dhaka kumar as an ordinary member and MP of the party.

Section 18 of the Political Parties Act lays down a provision for disciplinary action against MPs. RSP took action against Shrestha based on this provision.
